TERMS & CONDITIONS
Delivery, Set Up, Set Down and Access

The hirer is responsible to ensure the venue is accessible and ready for the installation and collection of the equipment at the agreed times of the hire period.

Be Cuckoo aim's to have everything set-up within 2 hours but it will sometimes take longer depending on access to the venue, any bespoke aspects of the venue location, which package has been hired and any demonstration period. The same timescales apply for set down however this may extend due to dark conditions.

In addition to the above, the hirer must ensure ease of parking and access to the venue for unloading and loading of equipment. If the venue is in a residents parking zone the hirer must be able to provide Be Cuckoo with a visitors parking permit on arrival at the venue. Any restrictions must be reported to Be Cuckoo prior to booking.

The hirer will forfeit the full cost of the hire if on the day restricted access prevents Be Cuckoo setting up and the hire proceeding.

Our hire packages include standard set-up and delivery to locations within 10 miles of DA12. For any other locations please contact Be Cuckoo as we can provide a separate quote for this.

Be Cuckoo will endeavour to arrive at the location and set up as scheduled, however from time to time delays can occur that are beyond Be Cuckoo's control or responsibility. We will of course contact the hirer as soon as possible to make aware of the delays and expected ETA.
Safety

Be Cuckoo do not accept liability for any accidents, injury or damage that may occur whilst the equipment is on hire. The equipment must be supervised at all times by a responsible person over the age of 18 (preferably the hirer).

It is the hirer's responsibility to ensure access to two 13 Amp sockets is provided to the screening location. Be Cuckoo will provide extension cables and advise on ways to safely provide power to the screening source but will not take responsibility for any problems that arise or accidents that are caused by cables infringing neighbours property, obstructing public footpaths or crossing public roads.

No food or drinks to be allowed on or near the Be Cuckoo cinema equipment.

No smoking or barbecues allowed near the Be Cuckoo cinema equipment.

Be Cuckoo like any business operator have a duty to observe safe working practices at all times. Should Be Cuckoo observe or deem something unsafe they have the right to request changes or refuse to allow the hire to proceed.

Be Cuckoo Cinema Equipment

We will provide equipment in a safe, working and usable condition. If the hirer is not satisfied with any aspect of the equipment, they should state at the time of set up before signing the Hire Declaration. Equipment will be deemed to be in good working order, except for any defects not detectable by reasonable examination.

The equipment is visually checked and tested at the hire location once the hire session has finished. Any damage (other than fair wear and tear) will be recorded and reported at the time of the time then repaired by Be Cuckoo and will be charged to the hirer. If any of the equipment is lost or stolen during the hire period, or extensions thereof, Be Cuckoo will charge the hirer the price of the lost or stolen item/s and potentially any loss of existing hire’s that cannot proceed due to the loss of that equipment.

If any equipment should fail while on hire the hirer should advise Be Cuckoo by telephone as soon as possible. The hirer should not attempt to repair any equipment without Be Cuckoo's permission.

If any equipment fails whilst on hire Be Cuckoo will do their best to supply a replacement. If the hirer is charging an entrance fee and the screening is delayed or cancelled due to equipment failure Be Cuckoo will not be held responsible for covering any compensation paid out by the hirer to their guests.

Be Cuckoo reserve the right to impose additional charges at the end of the hire period if the equipment on hire is not available to collect at the agreed collection time.

Common Disclaimer

Please note that all persons using this Be Cuckoo cinema equipment do so at their own risk. The person/organisation hiring the equipment will be responsible/liable for any damage or injury occurring from use or misuse of the equipment. These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are adhered to.

It is the hirer's responsibility to ensure that the venue they are showing a film has the appropriate premises license and that if required they have obtained the correct screening license.

Be Cuckoo takes no responsibility for the content that is shown on their equipment, arrange or provide any licenses nor provide any content (movies, box-sets, games) and any copyright infringement that may occur and subsequent offences and legal action are solely the responsibility of the hirer.

Be Cuckoo welcome any discussion prior to any booking be agreed regarding any and all terms stated and expressed within this document.

CANCELLATION & ALTERATIONS
Be Cuckoo can be significantly affected by late cancellations, matters which are beyond our control or issues created by a customer or other 3rd party, therefore we reserve the right to charge cancellation fees in certain circumstances. That being said, we value the meaning of great customer service and will always apply a pragmatic approach when faced with such situations with the goal of reaching a mutually amicable outcome.
Deposits

If the hirer requests to cancel a confirmed booking less than 14 days prior to the event, the hirer will forfeit 100% of the deposit.

If the hirer requests to cancel a confirmed booking between 14 - 21 days prior to the event, the hirer will receive 50% of their deposit.

If the hirer requests to cancel a confirmed booking more than 21 days prior to the event, the hirer will receive 100% of their deposit.
If the hirer requests an alteration to the original booking date, this should be done no later than 14 days prior to the event. All alteration requests are subject to availability and permissible for a £10 administration fee. If there is no availability of the dates proposed, cancellation terms would apply as above.
Weather

Be Cuckoo are unable to guarantee against rain, winds or other conditions that will have an adverse effect on the hire. As the main premise for the setup is 'outdoors' the hire is dependent on fair and good weather, therefore if on the day of the hire if persistent rain and/or strong winds are forecast we will contact you on the morning of the booked date to discuss what options are possible such as an alternative indoor venue with our smaller screen or postpone to another available date.

There is of course the chance the weather can change through the day despite the forecast. Should the onset of rain or high winds become obvious, the hirer should contact Be Cuckoo advising of such changes, we will make an assessment and if satisfied safe to proceed will agree for the use of the cinema to go ahead as long as the hirer follows our instructions for keeping the Be C cinema equipment dry. This is for the safety of all as well as protecting our equipment.

However, should the weather worsen we would expect the hirer to contact Be Cuckoo without delay and switch off the equipment at the power source (internal sockets) and ensure any electrical equipment (projector, sound system etc) is safely (and without any risk to persons) moved clearly under cover such as the gazebo or inside. In such circumstances it would be considered unsafe or permissible for the hire to continue and regrettably Be Cuckoo will not offer a refund.
Site and Venue Suitability

Be Cuckoo will always discuss the location for the setup with the hirer prior to any booking confirmation as there are specifics which apply in order for the equipment to operate safely and optimally.

Level dry ground, access to two 13 amp sockets (either indoor or garden sockets), sufficient area for the screen to be erected and that are free of lateral and overhead obstacles (tree branches, sharp bushes, overhead cables, outbuildings etc.)

If the hire is indoors and using the large 120" screen, we would need to be sure there is sufficient ceiling height.
A booking will only taken if the hirer assures our criteria can be met.
It is the responsibility of the hirer to ensure the venue is ready for the installation of the equipment at the agreed time. Should Be Cuckoo be delayed due to the venue not being ready or accessible charge may be incurred. Be Cuckoo aims to have everything set-up within an hour but it will sometimes take longer depending on access to the venue, any bespoke aspects of the venue location and which package has been hired. Should when Be Cuckoo arrive at site and discover that the site does not meet our operating criteria, we will inform the hirer that we cannot proceed with the booking unless immediate changes can be made to the site to enable the equipment to be setup. If within 30 minutes this is not possible or achieved the booking will be void and 100% of the hire forfeited by the hirer.
Site Access
It is the responsibility of the hirer to ensure ease of access to the venue for unloading and loading of equipment. Any parking fees or fines Be Cuckoo incur whilst setting up must be paid by the hirer. If the venue is in a residents parking zone it is the hirer's responsibility to provide Be Cuckoo with a visitors parking permit on arrival at the venue.
Any restrictions must be reported to Be Cuckoo prior to the event.
The hirer will forfeit 100% of the hire if on the day restricted access prevents Be Cuckoo setting up and the hire proceeding.
Force Majeure
Be Cuckoo cannot accept responsibility or pay any compensation where the performance or prompt performance of the booking is prevented or affected by reason of circumstances which amount to “force majeure”.
Circumstances amounting to “force majeure” include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the location set for the booking (which cannot reasonably be remedied to a satisfactory standard before the start of your stay) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic and all similar situations beyond our control.
It is explicitly agreed that an event of "force majeure" suspends execution of the reciprocal obligations for Be Cuckoo and the hirer, and that each party shall pay expenses resulting therefrom.
